The interesting issue: when should copyright lapse?
The main point of the suit, as said in the article, is worth considering.

Why not make copyright renewal depend upon request by the author? Many items would find a good home, and the authors would be grateful, if they could be asked.
There'd have to be ways to fix mistakes, no "Sorry, you're 5 minutes late" nonsense. But most work would see copyright lapse without mistake. Very few works have continuing commercial value.

Of course, the right place for this debate is Congress, not the Courts. But Congress is in thrall to some corporate absolutists. And every once in a while activists have persuaded the Courts to take over the legislative function and vote their (extra-legal) opinions. This wouldn't be the worst situation in which that happened.
