How will this play out in court?
A 2mb song can easily be downloaded from the same source hundreds or even thousands of times but a 700mb for a ripped to the max movie or 4.5gb for a slightly ripped dvd is not likely to be shared very many times even with a high speed line.

So what damages could they ask for? They would have to prove it stayed in a shared directory for a significant amount of time and there was sufficient line speed for the movie to be shared many times.

No money is being lost by those who download anyway. Those downloading would not have gone to the theater because if they could they would not bother to dl it and many who do dl it say they went to the theater and were grabbing it for someone who would not otherwise go anyway.

How much money are they making on something like netflix where I can rent and burn 12 or more movies a month?

Why don't they get with the damn program and just offer cheap high quality downloads of movies with the simultaneous release in the theaters. They have to change the paradigm that no one will go to the theater if a movie is also released on dvd or the net at the same time. In fact in would probably increase sales if the DVD was available in the lobby, after all right after you have seen the flick is when you are most hyped up to buy it it you like it. Those that want a theater experience will go regardless and those that simply want to see it at home will dl it or would buy or rent it. Why not offer a legal alternative to what is already taking place? Just how retarded are agencies like the MPAA and RIAA anyway?
