The essential difference is . . .
that with this setup, the RIAA, etc., will get paid according to the fee structure setup by the Copyright office. That, alone, may make it legal.

If this DOES catch on, and passes the court tests, you can bet that the next step the RIAA will take is to buy legislators who will help them raise that fee.
