The problem is..
The people at the patent office have no idea what is "obvious" with respect to software. For a company, it really boils down to:

1) Patent a stupid concept (and most likely, never use the patent for anything)

2) (Potentially) have someone else patent it.. and then sue you.

It's a sorry state of affairs.. but those are pretty much the only options available..
