Though many lawyers do believe that computer license agreements are over stretching thier sphere of control. Licensing was initially there to stop you from installing software then going to you local pawn shop to sell the disk while a copy still existed on your computer. Licensing is what gives you the right to copy software as that is what you need to do to use it. Anytime you obtain rights to copy a copyright protected work from the copyright holder you do so under a contract.

Now the license agreements have been extending further and further beyond thier purpose. Controlling what you do with your software is not what the license is for.

Now if Microsoft ever put in thier license that you can not run GPL software on Windows that would be crushed in court. At least that is the opinion of many lawyers. Why should this be any differnt for a video game? Still like I said this untested until all appeals and such are finished. Basically a supreme court descision is needed.
