I'm not familiar with the case you describe (links, please?) but your logic seems completely out in left field.

You purchase a piece of software - often times this software, explictly states on the box that the use of this software is subject to the terms of the license. And when you install the software, you are presented with the license agreement, which you must agree to, or the software will not install. And if you're so concerned about the terms of the license, and the store you intend to purchase it from does not accept opened software for return, then you can almost assuredly (I'm not certain on this.. never done it) contact the company in question and ask for their licensing terms.

Then again, given that courts have invalidated website privacy polices because visitors don't read them, perhaps the courts will do the same with click-through license agreements, because virtually nobody reads them?
