But I disagree with your fundamental argument, and I believe the court will also disagree. Companies do NOT generally have the right to dictate how you use their products. (For example, Ford cannot write in some hidden contract that says you're only allowed to drive on "approved" roads.) The user generally has the right to use the things he (legally) buys in any way desired. This is an inherent right of owning a lawfully purchased item; the user doesn't NEED to have this right enumerated or explicitly spelled out.

Once you agree that software is SOLD and not LICENSED, which the judge in Softman v. Adobe did, then the position that some contract--which you never signed or agreed to when you bought the product--restricts what you can do with your own property is ludicrous. If Blizzard placed a representative in the store, presents you with a contract, and then asked you to sign on the dotted line, then things would be different.
