Most of the P2P EULAs expressly FORBID trading in copyright files you don't have the rights to distribute.

On another note, though, the websites that have sprung up offering "unlimited" movies and music for 9.99/month (all they do is give you a copy of Kazaa, perhaps some other clients).. should be illegal. They are directly PROMOTING and PROFITING from piracy, using DECEPTION (they make it appear as if everything you download is legal and yours to keep).
