You missed the point.
Your example is the way it works NOW. But Congress could change the law, and it could work quite differently in the future. The RIAA proved that you can buy laws that bypass the courts and allow corporations to act almost as a law unto themselves. The Business Software Alliance actually has security agents who put on vests and accompany federal agents on warrant searches and arrests of suspected pirates.

Anything could change, for the right price.
