You left out an alternative.

Since DRM isn't working, nor will it likely ever work, the only alternative is to go after the thieves themselves, unless you want to argue that criminals should be able to get away with their crimes.

How about out-competing p2p?
Music at a reasonable price, easily located, quickly and conveniently downloaded, with as many legal uses as music (and movies) in any other format.
This wins, as we know.

The issue here is not thievery, which grew in the absence of legal download sources. The issue is the reluctance of the record and movie companies to give customers what they want.
When they do, customers use the legal source, at least primarily, and the illegal competition slowly evaporates because of the lacjk of available sources.

Can happen anytime. The RIAA and MPAA just have to decide when. So far, they prefer sending their best customers to jail. But I have to think that after enough executives are fired the companies will find some willing to live in this century.
I'm an optimist.
