True enough. I'm not sure how these companies justify their claims. It's not like Expedia is fooling people into thinking they're Orbitz by displaying the Orbitz mark. If they really wanted to establish that what Gator does is illegal, they wouldn't have settled and left the question open. After all, they don't have any agreement with Gator's rivals. As it stands, their trademarks still can be keyed and used to signal a popup from a competitor - just not by Gator. Go figure.


Unauthorized use of computer resources or somesuch brought by the victims of Claria would be much better.

That might work except there are no unauthorized use of computer resources. Everyone who has Gator on their PC has authorized it when they agreed to the EULA for the free software from Gator's partners such as Kazaa. If they didn't read the EULA before they agreed to its terms that's not Gator's fault.

Reading EULAs is a real pain but nothing compared to having Gator on your PC - or worse, Microsoft. Always read the EULA.
