I hate Claria/Gator too
But these lawsuits are not the right way to go about squishing them.

The web makes *no* guarantees about how a website is presented, the user agent has final authority. To say otherwise opens cans of worms you don't want opened.

Suppose the copyright owner is given full authority of popups or *LACK THEREOF*. Would you like them to say you can't run a popup blocker? As far as they're concerned, that is exactly the same as the Claria issue.

Unauthorized use of computer resources or somesuch brought by the victims of Claria would be much better.
