Unintended consequences

Two things to also factor in:
1) comparing the Napster case to the Grokster case--Grokster
saw how the Napster thing was going, and created their network
differently. Napster was liable, because they were serving as a
central clearing house for the files. Grokster got around this by
making it a distributed network that they could not control. Any
new laws will just drive changes in the technology that skirt
those new laws.

2) The new laws, such as INDUCE, are going to cause major,
major problems, because they're so vague, they essentially make
both the VCR and the Internet illegal. If you thought the
unintended consequences of the DMCA were ridiculous, you ain't
seen nothin' yet.
