Problem with Hatch is that he fancies himself an "artiste" and sells his "music" on the 'net. Since his sales have fallen, he has convinced himself that it's because everyone is sharing his work via P2P and not because the stuff is cr@p. At that point, he should not been allowed to participate in the debate because he is in a position to personally benefit from INDUCE passing.

As for the "Don't INDUCE" Act, it is a step in the right direction because it is aimed at the true pirates-people who engage in commerce to illegally sell copies of commercial material.

And that is the key point-COMMERciAL DISTRIBUTION! Whether it is on-line or at the local flea market, making commercial-grade copies of whatever and SELLING them is not legal, nor should it be.

Downloading a song that you own on 8-track and can't find anywhere else is not a crime, much as No_Ax and his ilk would have you believe otherwise (and the courts have ruled as much). And if it is for non-commercial purposes, then the RIAA needs to move on and fix THEIR internal problems, because that is where the money hemorrhage really is.

It's the distribution that the RIAA is filing on, anyway. You can download all you want, but you can't leave the files in a shared directory because there is a "potential for distribution/uploading/copying." But unless the RIAA can prove those files are being sold, they are still going to be SOL in the end.

End of shelf life for RIAA and for Hatch is coming up fast.
