Uh huh. And we didn't read about the people developing a program and system to replace Napster using the current approach exactly because it evades Napster's culpability.

Courts cannot pay attention to what "everyone knows". They need evidence, thankfully. But let's not violate common sense in this discussion.

The argument against the content companies' use of the Federal government's powers for their own purposes is very strong. But it's not based on a redefinition of property to suit the purpose. And it's also not based on pretending that the tools used to facilitate file sharing were written in total ignorance of piracy.

I agree with you that the content companies should be restrained. But we have to make solid arguments.
