Actually, the legality has not yet been determined as it applies to file-sharing applications. Settling lawsuits with the RIAA does not a legal precedent make. That will take an actual court decision.
In other circumstances, the Fair Use doctrine definitely applies. For example, I can copy an audio tape and give it to you. As long as I don't sell it to you for profit, it's perfeclty legal. By the same token, you cannot sell the copy I gave to you.
Alternatively, let's say the RIAA doesn't want you to have the latest Bomfunk MC's CD. I can just give you my original, whether or not I make a copy. You will still have copyrighted material that the RIAA doesn't want you to have, and no laws have been broken.
