Where are the loopholes?

All I see is that it wouldn't allow the entertainment thugs to illegally sue people that were not intentionally creating tools to help people infringe. The record/movie cronies wanted legislation that would allow them to blanket sue anyone that threatened their multi-billion dollar profits, whether illegal or not.
Creators of P2P software should not be held liable for infringement, any more than a gun manufacturer should be held liable for homicides used with guns. You know that this is the truth Bit. P2P creators did not make the software with the specific intent of infringing copyrighted works. It just happens to have become a very convenient tool to do so. They should be about as liable as Microsoft should be if the infringement is done with a Windows machine..;-)
