I don't see a problem with asking. I mean, I have absolutely nothing against the gay community. I have gay friends. But I wouldn't like to have a gay roomate, in the same way that I wouldn't like to have a female roomate, or I wouldn't like to have a very religious roomate. I would prefer to have a roomate that studies but also parties, that is easy going, clean, and cooks healthy. Is a matter of preference.

Discrimination at work is based on the fact that a person can perform a job equally well, regardless of his sexual orientation, race, etc. But living with someone is a different story. So I don't see a problem with asking that.

If it is illegal to ask sexual orientation, then it should also be illegal to ask gender.

But in the US, this doesn't surprise me. Its legal system, patents, lawsuits, and all that have imploded to the point that I'm glad I don't live there anymore.
