Looking at the Constitution it is readily apparent that the Federal government, not California, holds the authority to regulate and tax interstate commerce.

Ah... But there's the gotcha... Apple DOES, indeed have a physical presence in the state of California both as a.) their HQ in Cupertino, CA as well as b.) their Apple stores. Last I checked, iTunes is wholly owned and operated by Apple.

Nothing "interstate" about that.

Here is Wisconsin we have a ridiculous "use tax" for articles purchased via the internet (or for you older folks by mailorder). Theoretically the State of Wisconsin is not taxing the interstate aspect of the purchase, rather they are taxing your "use" of the item after it arrives in the state. Funny, Wisconsin does not tax the "use" of articles purchased in-state for which a state sales tax was paid.

Ok... So let's just say that they charged a "use" tax on items sold within the state of Wisconsin. This, on top of the state sales tax that's also being charged.

How popular do you think that would be? I'd wager that the people would be lining up at the state capitol building with pitchforks, tar and feathers if they decided to double tax those items.
