Napster had a central server which allowed knowledge of what music was being shared. That made the company liable.

When Napster was destroyed new software was developed which did not allow the writer(s) of the software to know what users were doing. That meant the developers were safe unless, as the Supreme Court determined, the developers had a business plan based on copyright theft and publicly advertised the plan.

Because Napster central knew about each download making a charge would have been easy once users were registered. Now that there is no central record, all unofficial file sharing software is useless for billing.

The music industry invariably made the problem far worse than it had to be.
