The WTO already has the Antigua case
Quoting:

The U.S. law banning Americans from wagering on Internet gaming sites was ruled illegal by the WTO in 2004. In April 2005, the trade body gave the U.S. a year to comply with its ruling. That deadline passed with little more than a statement from Washington that it had reviewed its laws and decided it had been in compliance all along.

Antigua Case

The WTO ruled in December that the U.S. owed Antigua and Barbuda $21 million in compensation for a ban on Internet gambling -- far short of the $3.4 billion the Caribbean nation had been seeking. Days before that ruling, the EU said it had won new trade concessions from the U.S. under a deal to compensate Europe for changes in U.S. pledges at the WTO on Internet gambling.

Is it a defense against an EU charge that the US is also discriminating against other countries' gambling operations?
