Agreed that penalties per illegal worker should equal the average local total employment cost for legal US workers - including pensions and meeting OSHA. This standard labor figure would relieve courts and juries from needing to here sob stories or exercise hasty judgment outside their area of expertise (no cause to cry unusual punishment). That way the employers actually lose money by hiring illegals; never saving money or breaking even.

I would grant an exception to penalties if not only did companies spend more than the average local total employment cost directly on that employee's support but also no normal or reasonable documentation indicted an illegal alien. That is employee facilities costs distributed among many employees don't count in support of that particular employee (especially executive gyms and country clubs even if illegals were allowed to enjoy caddying) .


Currently, from a strictly financial viewpoint, the current penalties hurt only if an employer gets caught frequently. If you only get caught less than once a year (<30% per year chance by federal admission) then you are saving a good deal of money.
