Yes, it does have to spell it out and no, it's not written in legalese. It's plain language. And there's no plain language in the AUP that says you can't run a server.


A server operating 24/7 is business activity.

Says you. Businesses have telephones. Am I a business because I have a telephone?


My friend that works for them says you must get a business account if you want to operate a server...

An email server is for your internal use and not external like a web server or it is an open relay.

What isn't defines in the TOS you can correctly assume is business activity.

In my world, what isn't prohibited is allowed. If the AUP doesn't prohibit servers then they are allowed.


Offering a Server so that others can download from is a business activity or enterprising endeavors.

Offering a website with pictures of my vacation is not a business activity. Period.

Thanks for your advice. I'll keep my servers, anyway.
