Operating a server is considered a business type activity.

Where does it say that? The word 'server' doesn't appear anywhere in RRs T&C or AUP.

I know RR knows I run a mail server because they are in my logs. They have logged into it trying to see if it can be used to relay spam. I never heard a peep from them about that server nor the website.

RR doesn't block port 25 nor port 80. If it didn't want servers it easily could block those ports.


Things do not have to be spelled out in a contract, just the behavior will do.

If RR didn't want servers it could just say so in the AUP, like Comcast does, but it does not mention servers. It also doesn't say what behavior is "enterprising." But the fact that it offers personal website space to consumers indicates that it doesn't consider personal websites an enterprise.

I have to conclude that RR allows servers on consumer netblocks as long as they aren't furthering an enterprise.
