None of the current P2P systems (including bittorrent) uses FTP. You are correct about the general ban on running "servers" using a residential account, but most of the ISPs don't bother to define exactly what a "server" is. Anything that operates in a peer-to-peer fashion could potentially be defined as a server, including any online gaming, file sharing, or even remote access software like Slingbox or just Microsoft's Remote Desktop access.

So, are the ISPs just going to declare NOBODY can do any of these things. No, because the public would start screaming to the FCC if World of Warcraft got shutdown, PC vendors couldn't do remote support, business people couldn't access their PCs in their home offices, and of course, if file-sharing programs just stopped working.

And the FCC is not the only place people can scream to. In my town, it's still up to the city council to renew or revoke the local cable franchise. If anyone thinks that Roadrunners "Terms of Service" is universal across the country, I suggest you read and compare ones from Minneapolis, Austin, San Diego, and Atlanta. Not all cable franchises are equal ...
