Read the TOS
Every ISP has a Terms-Of-Service (TOS) that every customer had to sign that saying they had read and understood the TOS and would abide by it. Almost all broadband providers (all I have checked, Comcast, Verison, Cox, RoadRunner, SBC, ect...) have a section in the TOS which lists prohibited activities. In Comcast's TOS is specifically prohibits running an FTP server or service on your home service. No matter how you look at it BitTorrent is an FTP server. So rather than drop you as a customer they choose to throttle back the connection speed of the program that is in violation of the TOS.
