Step AWAY from the MP3 issue for ONE second and consider the EFFECT OF THE WIDER PRECEDENT!"

Ok... Let's do just that. In wrongful death, the plaintiff knows the identity of the defendant. In cases like the one from this article, the plaintiff is trying to discover the defendant(s) in order to pursue the equivalent of a wrongful death case. I.e. the two scenarios are fundamentally different.

"what happens when THAT PRECEDENT is applied to a guy killed by the negligence of another individual?"

Nothing changes. Currently, even in the US, no officer or agency is required to divulge any info leading to a civil trial. What these copyright owners are doing is roughly equivalent to running up to a cop and asking for help finding the person who just slapped you in the back of the head when you don't even have clue #1 about what that person looked like, or even what gender!

It'd be an entirely different story if the copyright owners already knew the identities of the people infringing. That would be much more in-line with the wrongful death analogy.


The family now has NO RIGHT to know the identiy of the perpetrator? HOW do they sue
