Not everyone HAS free speech.
"A name and vocalized opposition to laws is not a offense."

But they can be used to demonstrate the "ready mind" to violate copyright laws - in combination with circumstantial evidence, this would be proof of motive to violate copyright law. I don't know how this would impact a court case in Sweden, not being a lawyer either in Sweden or my home country.

"You know free speech and all assuming their society has that."

Not a safe assumption. Many countries, even our allies, and even "civilized" neutral countries such as Sweden, impose severe limits on free speech under certain conditions. Britain, for example, prohibits publication of news regarding ongoing court trials.

"Also they haven't really broken any law in their country if what you read on their site is true."

Two unsafe assumptions in one sentence.

1) You can never tell when another country's laws will be violated simply by publishing certain things (it's a felony in some countries to deny that the Holocaust happened, for example, and people have been put in jail for doing that).

2) We have guys who call their Web site Pirate Bay and we're supposed to take their word for stuff having happened. Sure thing, Wilbur.
