what a lawyer will tell you to do
I'm a lawyer in Chicago. This may offend some people, but let's remember that a defendant has rights. A good lawyer will tell you that if there is any chance you are driving after drinking (or after taking illegal or prescription drugs (which may affect the breathilizer results) what you do is roll down your window about two inches, just enough to pass the cop your license and Illinois requires an insurance card. This helps the cop not smell alcohol or pot. DO NOT take any field tests. Just try to walk a straight line that is somewhat long when you are sober. It's tough. In Chicago they will always write that you failed even if you passed. You have an absolute right not to take the breathilizer and, especially not to give blood. Caselaw says giving blood is an invasive procedure which violates your rights to privacy, among other things. If you have an accident and your treatment requires taking blood (even if it doesn't the cops will tell the hospital to do it) then this will be used in court. If you don't give them probable cause then you will win your case. You may lose your license in the beginning for not taking the breathilyzer, but trust me, it is well worth it. The concequences of a conviction are usually very strict now as it is politically correct. When I began practicing you got a fine, period. Always chalenge the calibration and now the other settings of the breathilyzer if you take the test. Protect all your rights. The cops are going to lie, at least in Chicago & I suspect in many other places.
