NLSB and December 17th
The article could mention the December 17th National Labor Standard Board decision. I still am pondering it but the case involved three emails, two of which the NLSB decided an employee could be disciplined for and one which it is illegal for the employer to discipline. The first two involved union solicitation and the second did not. Because the employer had allowed email to be used for jokes and lunch invitations, as almost all organizations do, the NLSB decided all communications from work using work equipment that was not involved in solicitation was a right of the employee. It didn't matter that the equipment was owned by the employer. Its a major decision, I suppose.
