How about this:
I would introduce a bill that says that if the RIAA can prove that the total music volume was being violated then and only then would it be illegal.

Otherwise the total music listening/# of listeners at that moment would need to exceed the avg. # of songs / listening period.

For example, if you sell 1 million copies of an album then at any point in time there would need to be 1 million listeners, otherwise you have excess music listening capacity. Obviously some albums only have a few songs that are apprecieated more than the others. In this case you add in the # of single downloads and add that to the total music listening capacity. I doubt that any album has more than say 100K moment listeners so if an album sells 1 million albums then there will be a huge excess capacity.

Doesn't this make more sense? If someone has bought capacity then if they want to share it they should have that right...corect? It's just like Enterprise Rent-A-Car. They buy fleet vehicles with the intention that they will be used every hour of everyday. They don't buy them for the intention of having one person use the vehicle over the life of the product. This is also like letting a friend borrow a CD. They can listen to the CD, but you're the one that bought it. All digital transferring does is allow real-time borrowing. Think of it as a deck of cards. You are only holding the cards for a short while then returning them to the deck so that they can be doled-out again. At any point if someone wants a song(s) they submit their playlist and available entries are filled on demand.
