What about the consumers?
If Ebay wins consumers will continue to be conned into buying fake stuff at high prices.

If Tiffany wins consumers will be less likely to get conned into buying fake stuff.

Faking trademarks is breaking the law. Should Ebay and others be encouraged to aid (and profit on)criminal activity or not? That is the real issue here.
