eBay should win
It is up the the trademark owners to ensure that the items are real and not fake, so eBay should win this easily. All eBay is is a list. If they had to verify the items themselves, they could never offer to sell anything. All Tiffany has to do is offer a serial number with each and every item they sell and a verification service. This is why it is so hard to sell an imitation Rolex - you can check in 5 minutes if what someone is selling is real or fake.
