Statute of Limitations.
You, as a great many here, are forgetting a very important concept and that is the statute of limitations. A statute of limitations is a statute in a common law legal system that sets forth the maximum period of time, after certain events, that legal proceedings based on those events may be initiated. Regardless of your feelings on the matter if the statue of limitations is 10 years from knowledge of infringement then you get exactly 10 years to bring the case to the courts attention.

In some instances you can even bring the case to trail after the statue expires though in those cases you would first be required to explain to the court why you allowed it to expire.

Now, all this brings us to the burning question of "What is the statute of limitations in regards to trademark infringement?"

Well, quite simply, there is none.

In regards to the US of A there is no statue of limitations for trademark infringements as set forth in the Lanham Act. As such it matters not how long a time period there is between knowledge of trademark infringement and initiating injunctive relief.

15 USC Section 1116 discusses injunctive relief in regards to a trademark.

You should read it some time.
