Difference between publish date and Patent
If you publish a paper on a subject then expect to file a patent later...good luck. You may receive the patent, but as soon as you publish the paper it's essentially community property. Unless the paper has a patent# assigned to it or you've been approved to put "Patent Pending" then sorry.

If Larry and Sergey read the paper after it was published, but prior to the patent filing (not approval...only filing) then they have a right to use that IP as would anyone who read the paper.

I think that Google will be able to get out of this...JARG is just looking for a little coin in their pockets so they can retire. While I'm not necessarily a fan of Google I'm even less of a fan of people who try and profit off other's hard work. Larry and Sergey put in the time to get to where they are...other's didn't take advantage and they did...too bad JARG.
