Required to defend

My (limited) understanding of patent law is that in order to maintain the rights to a patent, you must defend the patent whenever you discover a possible infringement. This must be done in a timely manner as soon as it is discovered or brought to your attention. The lack of money to defend is NOT a factor. If this guy knew about the possible infringement, and didn't do anything about it for a long time, he may be in trouble.
