but they always manage to...open it up again, or even as you said.. put restrictions on access to it.. again in some way they work to try and make the area usable by all without denying people the access.

You can't hold the creator of the park accountable for someone coming in and shooting someone else ... you can however sue the government that is in charge of maintaining the land for not having taken precautions...

A club is not the same, as its a privately owned space, and then turned into a business, which is in fact, making money off of having a diverse set of people come to the premesis. If the club did everything they could to protect those *inside* then its less likely it would be closed down for things that go wrong beyond their control.
