Only one publisher to be held accountable? Correct, and its the kid that put the video up there before going on that shooting rampage.
You could also look to see how many other persons watched the video and didn't select the option to complain about it.
And the next problem to takle is.. when does this impinge free speech? I can post on line that I'd like to kill my neighbor, and have that protected as free speech, so why would this have been any different?
I would expect, that were I to do so, that I might get a visit from the police, investigating how serious I may be, and if I pose a threat to my neighbor ... and that's where things *should* go, ... someone should have reported the video, someone reviewing the video could have gotten the sense that the kid was distrubed, turned it over to the police, they could have investiaged, and perhaps stopped this kid..
its all a matter of timing, review, and the medium of the day.
posting to Youtube, or any other site is similar to pinning a note on a bulletin board with something to identify you on it.
Try it some time.. put a sticky note up at the local supermarket's bulletin board, saying that you're going to kill someone, and leave your name and number on the back.
when the police come (if they do) or you get calls, you can tell them it was really just to see if anyone paid any attention to such notes, and to see if anyone *would* turn the note into the police.
And in your logic, the supermarket then would be held accountable for putting up a cork board and allowing people to post messages on it, without checking each one's content.
