How about this...

How about this... Assuming we have the drugs and technology to do this safely:

1) By default, everyone is taking a contraceptive that is administered (through drinking water or whatever). Both men and women.

2) If a couple WANTs and PLANs to have a baby, both the man and woman take the antidote daily for at least 30 days (or some other period). After 30 days of the antidote, the contraceptive is disabled, and they can try to conceive in the usual way. Both man and woman have to take the antidote until the woman is pregnant. When the woman becomes pregnant, they don't have to take the antidote anymore, until the next time they wish to PLAN to have a child.

3) The antidote would be available free of charge, to anyone who wanted it. There would be no tests or other judgements by "experts". If both the potential mother and father have the wits and determination to plan ahead and WANT to have a child, and can follow the regimen of taking the antidote every day for as long as needed, then they are "capable" of getting pregnant.

4) This "you can only get pregnant if you plan ahead and both parties agree" scheme would probably have prevented both of Esperanza's pregnancies. And, it would also prevent many other unwanted and unplanned pregnancies from one-night-stands and similar casual encounters.

Okay, maybe we don't presently have the drugs to safely do this right now... I don't know. But, the main objectives are:
- Only get pregnant when you want to, and with a certain period of planning and commitment beforehand.
- Both the man and woman have to participate in the "plan"
- No courts, judges, or other experts will determine who "gets to be pregnant
- The "means test", as it were, is to be able to follow the simple regimen of taking the antidote for X days. If you cannot do that, then you're probably not ready for parenthood.

Not a perfect scheme, and I'm sure it'll attact some flames, but it would be an improvement on what we have, wouldn't it?
