Was his using the Web for nonbusiness reasons proven?
It seems to me that the judge may have failed to address the issue of whether or not Farr even used the Web for nonbusiness reasons?

Not to mention the question of whether or not one of the female RTs on the staff may have surfed the offending Web sites. It's a weird world out there, kids....

No, I think it's much more probable that this case was decided on something other than the facts.

I also find it reasonable that under HIPAA that St. Francis Hospital could be held responsible in general for running its IS infrastructure so sloppily that Farr's innocence or guilt could not be established from an examination of the security records.

Perhaps Farr is not the injured party as such, but that makes St. Francis no less actionable foe its failure to comply with HIPAA.
