Geez, get off the technical drift...
It has NO STANDING! Slander, false accusations? Where's the damage?

How has this person been damaged? One must have a damage, or a litigation is without basis! Loosing his job is NOT damage! His employer didn't publish that this person was a purveyor of smut!

When this employer tells another potential employer that they fired him for smut viewing, and then this potential employer refuses him employment based in any part on the merit of that report... thats actionable! NOT until! Most employers have a "NO TELL" policy. potential employers who call previous employers get a neutral response. Yes, he worked here. From Jan. 02 to Dec. 07. Why did he go? "We have a policy of not discussing this whether positive or negative", is the industry standard. Why? Duh! It's actionable!
