There's no question this guy got a srewover! It makes no difference whether this guy did or didn't do what was alleged, period.

This judge is 100% correct regardless of how bad the hospitals actions stink! I live in a "At will" state also and have been down the "screw job" road from an employer twice!

"At Will" means just THAT! No reason needed. You can come in one day and your supervisor can just say "Your fired", leave everything behind, security will take you out NOW! We'll go through your "Stuff" and mail you what we think is yours along with your final pay check, and you have NO recourse. That they gave him a reason is of no legal importance. Ugly? Yes.

"At Will" employment is a state by state legislative issue. It's also called "Right to Work", and is a direct response to the states or unions that have legislation that supports a workers union right to refuse a worker entry or membership into that union and therefore prohibits that persons ability to work for that employer.

"AT Will" trumps fairness. Where it counts is "Unemployment Compensation". Having been dismissed, one can be denied Unemployment compensation for "dismissal for due cause". That cause is usually defined in statutes and has strict guidelines governing corporate behavior in the dismissal process.

Yes, this is a provocative case and seems to be very unfair, and might well be! But the judge is 100% technically correct! She must follow the LAW, not hallucinate every time she sits in judgment.

The correct place to address this is in that states legislature.
