That is my take on this and it fits with the patty dunn HP case because that is basically what she did in trying to discover which board member was leaking information to the press. So before an employer can snoop, the employer needs to get a court order - assuming the person being snooped on is a US citizen.

I think the same has always been true for phones. An employer gets a record of calls but is not allowed to listen in. It doesn't matter if the employer owns the phone equipment.

This could be great for Web 2.0. It could mean that US citizens can My Space at work with the only limitation being if doing so impacted job performance.
