Derivative works Piracy.
Many films are indeed "mash ups" and not worth seeing, but that
does not mean that they do not have sufficient elements of
original content to deserve legal protection.

Are properties selected to minimize expenses? Well duh, of
course they are, big surprise especially if some of the people
who have something want more money than the producers think its
worth. There is no point in making something if there is zero
chance at making your money back, assuming you are business and
have to pay back your investors.

Story owners are compensated, the same with song writers and
other contributors, though they may not get nearly as much as
some of the other participants in the movie. Even if the story
is key, you usually end up with a director or star pulling in
more money, but if you sign the contract and are stupid enough
to accept the studios concept of "profit", well you just have
not paid enough attention to the real world now have you?

The deals are often not fair, but that is not really piracy,
though I do think some light on the book keeping practices might
force some changes. I mean, it was only recently that the
record companies stopped deducting money for the "new" cd format
expenses. I'd really like to see companies forced to cough up
the money they get from Apple and others go more directly to the
artists, I have no idea where it goes now, and neither do the
smaller artists.

The long term question is to what extent do we allow content
creators/providers control how we use what they create.
If the public refuses to buy it, it goes the way of DIVX
(DVD with built in time limits) and good ridance to bad rubbish.

I think that over the long term you will have musicians come
together in a union or alliance to bypass the existing
structure to directly get the money. I mean, the cost of
production is low enough that you can get near studio sound for
a small percentage. If a band has some success, they are better
able to leverage a fair deal, assuming they don't just sign the
first piece of paper put in front of them. happy
