Searching = illegal?
If using the search engine to see if illegal content is available on the web, they are also breaking the law by using the search engine to verify their content is present there. In other words, they also searched for illegal content.

Also consider that there ARE many LEGAL torrents out there. The technology itself is not illegal. Using a search engine is not illegal. TorrentSpy is just a search engine. Nothing more, nothing less. Why is that illegal?

It makes me wonder (facetiously) - Can Microsoft be held accountable as an accessory party since their popular Internet Explorer program allows users to access TorrentSpy (et. al.)? Mozilla (Firefox)?

I suppose that logic would make a home computer an illicit device since it ENABLES users to use illegal MP3s and watch movies they don't own. And don't get me STARTED on Apple's video iPod... "You mean these criminals can WALK AROUND with my movies?"
