ascap & bmi

this has to do w/ the music industry'sdesire to prosecute and the likely payout from the defendant. i've worked in 2 jobs where this is prevelant, radio and a ski service/retailer. it's obvious that a radio station is using copyrighted material for profit and that's why they pay monthy/yearly dues to ascap & bmi, but what about a smaller business that isn't really using music as it's main product/revenue generator? this is why there is muzak, and it comes in so many flavors including hard rock and ska. the ski shop(s) i worked in merely wanted background music for the shopping public to enjoy their experience as well as the employees to have something to break the monotony of the slow times, yet they were fined 5 seperate times to the tune of $5000 per each incident even though probably any person there would have been there because of the store, not because of the music. good luck on that front.
no, this has to do w/ a person providing entertainment w/o a release from the performer, and of course, the riducule of the headline. i doubt he would have been fined w/o the dig, it was only a recplay, w/o profit, of an actual event, same as news, but you stilkl need a release.,
