What about bands?
It's fuzzy whether or not the record industry can hassle someone who sings a copywritten song in public; I don't think the teacher knew she was being videoed, did she?

Cover bands perform copywritten songs in public all the time.

No, I believe that the student know right from wrong at his age, and was hassling the teacher. YouTube is a public place, and humiliation in public (let's get real, that's what the kid was doing), should be actionable in all free countries for private citizens (we have laws in the U.S. concerning libelling public figures, or John Stewart would've been lock up years ago :)).
