You missed the point

Rapson's message was intended as tongue-in-cheek, iterating all the excuses given for piracy, among other things.

The real point, however, is that this is a legal, contractual dispute. "Justice" or "ethics" has nothing to do with it. If the artists' attorneys can find good reasons to support a contention that the labels are violating their contracts with the artists, that's what negotiations and courts are for. Apple was brought in, I suspect, just to heighten the interest. I'm not an attorney, but it seems to me that, as a licensee, Apple would almost surely indemnified as long as they had good cause to believe that the labels had the electronic distribution rights. Apple would likely be no more liable than a music store would be in a similar dispute over CDs.
