If I were to actually listen to or watch the smut that is put
out by the "entertainment" industry, I would be willing to pay
a reasonable price. However, if after paying this price and
finding out that the CD that I paid for put spyware (or other
software that crippled my system) on my computer, I would be
completely justified in downloading content (without paying)
from then on.

Sony and others have breeched the trust of their customers with
their covert malware installations. Since it costs so much
time and money (not to mention possible data theft and loss)
for system recovery efforts, customers have a right to recover
damages. Unfortunately, the current court system makes legal
recovery options out of the price range of the average
customer. Copyright infringement is the one of the few options
customers have.

The U.S. Constitution gives Congress authority to promote the
progress of SCIENCE and USEFUL ARTS, by securing for LIMITED
TIMES to AUTHORS and INVENTORS the exclusive right to their
respective writings and discoveries. Note the words that I
have capitalised. In order for a copyright to be
constitutional, the work copyrighted has to be a USEFUL art or
science, and the copyright has to be for a LIMITED TIME.
Copyrights today are effectively unlimited, and most of the
smut put out by the "entertainment" industry can hardly be
considered a USEFUL art.

IMHO, the "entertainment" industry have painted themselves into
a corner by purchasing legislation that gives unlimited
copyright (unconstitutional), destroying legitimate
competition, sabotaging customers' equipment, and overcharging
for their smut. They are now reaping what they have sown for
so many years.
