"Any rebroadcast, reproduction or other use of the pictures and accounts of this game without the express written consent of Major League Baseball is prohibited" does make it sound like fair use does not apply. This statement does actually state that you are prohibited from recording the broadcast on your VCR unless you have the written consent of MLB...so unless you know all about fair use it is very misleading. Of course, I don't think the statement has ever stopped anyone from recording the game on their VCR, but that's not the basis of the complaint. The complaint says the statements are misleading, which they obviously are since they contradict fair use. This complaint has some real teeth.
